Action in the Otter Tail County District Court for personal injuries and for damage to plaintiffs tractor resulting from a collision with two other tractor-trailer units. One tractor, owned by defendant Calvin Shue, was pulling a trailer owned by defendant Manferd Seath in transporting property for defendant National Reefer Service, Inc.; the other unit, operated by defendant Robert J. Williamson, was owned by defendant Farmers Union Federated Co-op Shipping Association. The case was tried before Byron R. Wilson, Judge, and a jury, which returned a verdict for plaintiff for $11,000. Defendants Calvin Shue and National Reefer Service, Inc., appealed from an order denying their alternative motion for judgment notwithstanding the verdict or a new trial, and defendants Farmers Union Federated Co-op Shipping Association and Robert J. Williamson appealed from a similar order.
